IDENTIFICATION

These USUKIYAKI Global and USUKIYAKI Wholesale Store are operated by Musubi Lab LLC, a limited liability company, established in Tokyo, June 2020 at the following address: 1-31-9-201 Ookayama Meguro-ku, Tokyo,152-0033 Japan, under the supervision of Sekibutsu Kanko Center. Throughout the site, the terms “we”, “us” and “our” refer to Musubi Lab LLC,. 

1- ACCEPTANCE OF CONDITIONS OF SALE

The customer acknowledges awareness of the specific terms and conditions of sale when placing the order, and declares acceptance of these terms without reserve. These general terms and conditions of sale govern the contractual relations between Musubi Lab LLC and the customer, and are accepted by both parties without reserve. 

2 - PRODUCTS

Musubi Lab LLC cannot certify that all products online are available. Items in our store usually take about 2 months from the time of payment to the time of shipment. However, please place your order with the understanding that it may take longer due to the handmade nature of our products. Cancellations and refunds cannot be accepted for items that are in production after an order has been placed.

Musubi Lab LLC is happy to supply details about the quality and origin of products, as well as a translation of conditions of use. Please note, however, that not all products will be labeled in English. Except in the case of a specified agreement, labeling is the responsibility of the reseller.

Our products are characterized by the natural texture created by craftsmen's handiwork and natural materials.

Products have characteristics as indicated on the Product Quality page, and these are not defects; orders cannot be cancelled or returned due to the condition of the product as described on the Product Quality page.

If you see a defect in the product that you believe does not fit the condition described, please contact us within 3 days of receipt of the product with pictures. If we deem it to be a defect, we will accept the return or exchange of the item(s) in question. After this period, returns or exchanges will not be accepted.

All products in USUKIYAKI Wholesale Store meet standard or technical code requirements for quality, safety, hygiene, environmental protection, labeling, etc. of Japan. These may differ from the requirements stipulated by the purchaser's location, and its risks and responsibilities are on customers.

3- ORDERING

Goods are available for sale to buyers with a USUKIYAKI Wholesale Store account only. You need to create an account to see prices.

The automatic order placement systems are considered as proof of the nature, content and date of the order. Musubi Lab LLC confirms the acceptance of the customer’s order by email to the address provided by the customer.

The sale is completed only once the order has been confirmed. Musubi Lab LLC reserves the right to cancel any order placed by a customer with whom there is an existing dispute regarding the payment of a previous order. In the event of an error in the delivery address, the vendor shall not be held responsible for any impossibility to deliver the product.

Canceling/Changing Your Order: we cannot guarantee that your order can be canceled or altered after it has been placed. You may contact us as soon as possible to see if your order has already started to be processed.

Orders that have been prepared (even before shipment) cannot be canceled and will not be refunded.

4 - TRANSPORT AND DELIVERY

Delivery terms : Ex Works Factory (EXW)

Packages will be sent from Musubi Lab LLC.

Except in the case of a prior arrangement, all deliveries will be made by DHL.

Once the handover of a shipment occurs, Musubi Lab LLC the client will be supplied with a tracking number which can be used on the carriers website

Items are shipped at ‘international economy’ rates, and the average transit time is 2 to 5 days with DHL.

Musubi Lab LLC charges delivery to the reseller. The charges include delivery to the address specified by the client.

In the case of a product broken in delivery, or missing, please advise us and send pictures within three days.  After this period, no responsibility will be taken for breakages.

Delivery to Japan is possible, but you will be obliged to pay the Japanese consumption tax (10% of the total amount).

5 - INCOTERMS, TAX AND DUTIES

The Contract of Sale is made under the terms provided by the Incoterm DDU: Delivered Duties Unpaid (charged to the buyer).

Payment of taxes and duties will be charged to the client by DHL. These costs include the sales tax in the country of delivery (applied to the total cost of the order), duties on the cost of products (around 6-7 percent for US, Singapore and the European Union) and fees to the carrier.

Delivery Insurance: The costs associated with delivery guarantees shipments against any damage or loss by the carriers. Upon delivery, please check the condition of the shipment in the presence of the courier. In case of apparent damage, please decline the shipment concerned.

6 - PRICE

All prices, discounts and transportation charges are calculated based on Japanese Yen and are subject to change without notice. For purchases in currencies other than Japanese yen, the applicable exchange rate will be determined based on the rate at the time the order is confirmed.

The price shown on the product description does not include delivery and not does include taxes and duty. 

7 - PAYMENT

Every order must be paid in full at the time of order unless otherwise specified.

The price billed to the customer is the price shown on the order confirmation sent by Musubi Lab LLC. Secure payments are made by credit card or bank transfer. Bank transfer is only valid for payments of 100,000 Yen or more in Japanese yen only.

If you pay via bank transfer, bank account information is found below. 

(Note that Japan does not recognize IBAN).

Late Payment and Fee Schedule :

You will be charged a late payment fee for being more than 30 days late after the shipment date of your order. There will be a 15% interest charge after the first 30 days plus additional 10% per month of your unpaid invoice.

8 - CONFIDENTIALITY AND PUBLICATIONS

Product images on the USUKIYAKI Global and USUKIYAKI Wholesale Store, made in our own studio, cannot be used for products sold online. 

High definition stock photos can be supplied in the case of a press release and on condition that they are labeled “photo – Musubi Lab LLC”.

The client agrees to respect the confidentiality of our prices.

9- JURIDICTION

In the event of a dispute, an amicable solution will always be sought before considering possible legal action.

The present conditions are subject to Japanese law, and the legal proceedings will take place in the country of domicile of Musubi Lab LLC.
